The funny thing is that if someone wants to register the IP address of your site to something like this there's bugger all you can do about it
That said I suspect Derek will be doing a whois search and then shouting about suing someone very soon
BTW : Smart's site. It's crap isn't it. I mean look at all that blank space in the middle. I'd be the first to admit that I don't know HTML that well and yet I think I could do a better job than that. (And I'm not even an alpha male!)

I don't think whois actually covers .tk domains...
